other types of unclaimed funds

  • tax deed sales:

Occurs after a homeowner fails to pay delinquent property taxes. The county will conduct tax deed sales and issue a tax deed in the name of the county to the successful bidder at the auction to collect the delinquent taxes.

Overage occurs when the amount the bidder purchased the tax deed for exceeds the amount of delinquent taxes.

  • foreclosure sales:

Occurs after a homeowner becomes delinquent on their mortgage payment and the mortgage lender initiates a foreclosure action that results in an entry of a final judgment and sale of the home at an auction.

Overages occur when the amount the successful bidder purchased the home for exceeds the final judgment of delinquent mortgage.

In both tax deeds and foreclosure sales, the record titleholder and/or original homeowner of the property at the time the delinquencies were recorded are entitled to the overage funds.

There may be potential claims and other parties with entitlement. In such cases, it is crucial to carefully review all relevant documentation and agreements to determine the validity of the claims and the rights (if any) of the other parties.
